Yes! The passage of the Arbitration Fairness Act will return due process rights to the people. Arbitration in Franchise Agreements is particularly harmful and tends to taint our legal system. The Aeventh Amendment to the Constitution that allows juries for commercial disputes has been sacrificed under the cover of the Federal Arbitration Act that Congress and the Courts have deemed to trump federal and state law but can the Federal Arbitration Act trump Constitutional Law?

Was the FAA intended to promote arbitration between very strong and financially powerful parties and independent and and naive small parties who have to incorporate themselves to buy a retail franchise?
